1:45 pm - 2:00 pm | Emerging D&O Claims Risks While the count of merger objection and derivative lawsuits is declining, the variety of case causes impacting D&O policies continues to expand. This session will explore emerging claims sources including patent infringement, the Foreign Corrupt Practices Act (FCPA), the Video Privacy Protection Act (VPPA) and False Claims Act. Each of these areas of law has existed for a number of years, they are emerging as a source of concern for D&O underwriters.

2:00 pm - 2:30 pm | The Buyer’s Perspective This panel will cover topics including whether D&O insurance is adequately responding to those risks and the reality of information sharing between the insurance industry and buyers. They will also outline what factors drive the purchase of D&O liability cover in their organizations.

2:30 pm - 3:15 pm | Globalization of D&O As companies expand globally, so too does litigation. National and global regulations are growing more stringent, and have broader reach. Trends such as litigation financing are becoming prevalent in Europe – how long before they reach US shores? This session will look at US and global regulatory and litigation developments and address how the insurance community is responding.

4:15 pm - 5:00 pm | Privacy and Network Security Issues This session will explore the vulnerabilities of public and private companies of all sizes to data breaches and privacy violations, and examine the types of scenarios that could place directors and officers in the cross hairs of regulators, investors, customers or other interested parties. How have these claims played out in reality?
