Corporate bankruptcies remain at an elevated level, exposing directors and officers of insolvent companies to increased risk of lawsuits by trustees and other stakeholders, and almost all companies and their directors and officers to claims arising from heightened counterparty risks. 1:30 pm - 2:15 pm | The Risk Manager’s Perspective on the D&O Market What do risk managers perceive as the most significant risks to their companies’ directors and officers? Is the insurance market doing a good job of addressing those risks? What are their frustrations in dealing with insurers and brokers? What alternatives to insurance, if any, are being employed to manage these risks? A panel of risk managers will discuss the range of risks to their organisations’ directors and officers and evaluate the effectiveness of their brokers and insurers in addressing their needs and concerns. |
2:15 pm - 3:00 pm | It’s getting personal. The focus of legislators, regulators and prosecutors is increasingly on individual accountability rather than simply on corporate responsibility. It’s not just anti-corruption legislation but also in the fields of anti-trust matters, environmental, health and safety, tax, sanctions, money laundering, the regulated sector and financial reporting that individuals are being targeted. No longer does the corporate veil provide the protection to managers that it once did. This trend looks set to continue and strengthen. Against that background, it is timely to consider how well suited D&O insurance is to meet these new challenges. Does the product need to adapt and, if so, how? Does the one size fits all approach still hold good? A panel of experts will debate these issues.” |
3:00 pm - 3:15 pm | Afternoon Break | |
3:15 pm - 4:00 pm | Privacy and Network Security Issues for Directors and Officers Increasingly, directors and officers are being held accountable for the security of customer information and other sensitive data under the control of their companies. In the U.S., directors of companies who have been breached are being sued by shareholders, and regulators are ramping up investigations of board-level data governance activities. What are the responsibilities of European directors and officers for data security? Will they also be targeted by shareholders, regulators and other stakeholders? A panel of legal experts in management liability, privacy and network security will present their insights. |
