The cybersecurity regulatory landscape is evolving, with regulators shifting to pre-breach risk mitigation requirements rather than post-breach guidance. Examples of this new wave of regulatory thought include the European Union’s General Data Protection Regulation (EU GDPR) and the New York Department of Financial Services’ recent cyber regulation for banks and insurers. The effects of these regulations will be felt across the globe and other jurisdictions are likely to adopt similar rules in the future.
